Town Council Passes Resolutions Against Multiple Proposed Bills from the Texas State Legislature

UPDATE (May 5): As staff and Town Council continue to track bills in both the House and Senate, we’re monitoring several that could limit or alter local governments’ authority to manage development, land use, and density in residential areas: House Bill 2789 and Senate Bill 1412, as well as House Bill 3921 and Senate Bill 1787.

H.B. 2789 and its accompanying S.B. 1412 have both passed through their respective chambers. These bills would preempt many local government regulations and limitations on the construction of accessory dwelling units (ADUs) and would greatly expand both the ability to construct ADUs and the amount of allowed ADUs on single-family lots. H.B. 3921 and its accompanying S.B. 1787 would prohibit local governments from requiring lots larger than 1,400 square feet and would prohibit the adoption or enforcement of certain requirements for small lots, allowing an increase in residential density. H.B. 3921 has passed Committee and will go to the House floor, while S.B. 1787 is left pending in Senate Committee. Read H.B. 3921 here.

UPDATE (May 3): We have a few legislative updates to share with you over the coming days, as staff and Town Council continue to monitor House and Senate activity that could affect local government authority. First up, House Bill 2127, which passed the Texas House in April, and its companion bill, Senate Bill 814, that has been left pending in committee. These bills would limit or eliminate the ordinances or rules that a governing body of a municipality may adopt, enforce, or maintain to such ordinances and rules that are consistent with state law.
