Violations

Failure to Maintain Financial Responsibility (Insurance)

If you were issued a citation for Failure to Maintain Financial Responsibility and you in fact were covered by an insurance policy at the time the citation was issued, you may present proof to the court to have your citation dismissed. The proof must indicate the following six items:

  1. the name, address, and telephone number of the insurer
  2. the insurance policy number
  3. the policy period
  4. the name and address of each insured driver (including the driver cited with the violation)
  5. the policy limits or a statement of coverage complies with the minimum amounts of liability insurance required
  6. the make and model of each covered vehicle


If your proof does not reflect all six requirements, the court will not accept your proof. You will either have to obtain a new card from your insurance carrier reflecting the necessary requirements or provide your insurance policy with the information included or obtain a letter from your insurance carrier on company letterhead stating each of the requirements that are not indicated on your insurance card. Without proper proof you will be assigned a court date to present proof to the judge.

A second or subsequent conviction of an offense under the texas motor vehicle safety responsibility act will result in the suspension of your driver license and motor vehicle registration unless you file and maintain evidence of financial responsibility with the department of public safety for two years from the date of conviction. The department may waive the requirement to file evidence of financial responsibility if you file satisfactory evidence with the department showing that at the time the citation was issued, the vehicle was covered by a motor vehicle liability insurance policy or that you were otherwise exempt from the requirements to provide evidence of financial responsibility. TRC 601.233

Expired Motor Vehicle Inspection

If you were issued a citation for Expired Motor Vehicle Inspection and it has not been expired more than 60 days, you may present proof of correcting the violation within 20 working days from being issued the citation and the Judge may dismiss the violation with a $20 dismissal fee. Proof of compliance must be presented to the court clerk. The court will not go into the parking lot to verify the correction. The person issued the ticket is required to provide proof of compliance. Proof must be delivered to the court office within the first 15 days after receiving your citation. If you fail to provide proof as required, a Failure to Appear (FTA) charge will be levied and can result in an additional $292.00 fine.

Expired Registration

If you were issued a citation for Expired Registration and you have :
A.) Corrected the violation within 20 working days of the citation being issued
B.) Paid the delinquent registration fee as required by Transportation Code, Section 502.176 
The Judge may dismiss the violation with a $20 dismissal fee. Proof of compliance must be presented to the court clerk. The court will not go into the parking lot to verify the correction. The person issued the ticket is required to provide proof of compliance. Proof must be delivered to the court office within the first 15 days after receiving your citation. If you fail to provide proof as required, a Failure to Appear (FTA) charge will be levied and can result in an additional $292.00 fine.
