If charged with a traffic offense under the Subtitle C, Transportation Code, a request may be made to take a driving safety course. A driving safety course may be take to dismiss a citation if the driver was not charged with speeding 25 miles or more over the speed limit. A request to the court must be provided, either by mail or in person, within 15 days from the date of the offense with the following five items:
Within 15 days from the date of offense, mail or bring the five items listed above to the court and upon approval, the court will grant permission to take the course. If applying by mail, please wait to receive permission from the court before taking the course.
Prosecution of the traffic offense will be postponed for 90 days to allow the driver to complete the course and receive a certified driving record copy from Austin. Upon submission of driving record and proof of course completion, the citation will be dismissed. The court cannot accept either document independently.
The court is not allowed to recommend a driving school. Please refer to the Texas Education Agency Web site to find a driver safety course in your area.
If any requirements are not completed by the due date, the case will be set for a Show Cause Hearing to provide an opportunity to present evidence to the judge as to why the requirements were not complied with. A court date my be requested, or the court will schedule one and send notification to the address provided. Failure to appear at the hearing will result in a judgment being imposed. A ten-day period from the hearing date is provided to allow the driver to either pay the fine or appeal the judgment. If payment or appeal are not received, a Capias Profine Warrant will be processed. A written request to waive the Show Cause Hearing and pay the remaining balance of the fine may be submitted to the court.All payments should be made payable to the Town of Flower Mound.
